What is the Single-Use Plastics Fund? A legal responsibility for manufacturers


Since the Single-Use Plastics Fund Act (EWKFondsG) 2024 came into force, manufacturers of certain single-use plastic products (e.g., plastic bags, plastic food packaging, plastic cups, balloons, fireworks) are legally obliged to submit an annual quantity report. The aim of the law is to allocate the environmental follow-up costs of plastic waste and single-use plastics to those who cause them – especially for products that frequently end up as waste in public spaces. The collected EWKFondsG levies flow into the so-called Single-Use Plastics Fund, which is intended to refinance municipal collection and cleaning services as well as awareness campaigns.


To ensure the correctness of this information, § 11 EWKFondsG stipulates that the annual quantity report of plastics first placed on the market must be checked by a certified auditor (expert, tax advisor, or auditor). This quantity check must not only be carried out in due form but also demonstrably provided with a qualified electronic signature. Without this proof, sanctions and fines are threatened.

In principle, the testing obligation affects all manufacturers, importers, and distributors within the meaning of the EWKFondsG who place single-use plastic products (i.e., plastic) on the market in Germany – regardless of company size or the corresponding quantities of plastic. Therefore, anyone who sells, for example, wet wipes, tobacco products with filters, food containers, beverage cups, balloons, fireworks, or carrier bags often falls under this legal regulation. Even if you offer your products through online retail, wholesale, or direct sales, the testing obligation applies. Butchers, snack bars, and bakers are particularly affected.
